Deluzio, Moylan Reintroduce Bipartisan “Best Price for Our Military Act” to Crack Down on Defense Contractor Price Gouging

WASHINGTON, D.C.  – Today, House Armed Services Committee members Congressmen Chris Deluzio (D‑PA‑17) and James Moylan (R-Guam) re‑introduced the Best Price for Our Military Act of 2025, legislation designed to protect public funds and combat defense contractor price gouging. The language of this bipartisan bill was also included in the committee-passed version of the Fiscal Year 2026 National Defense Authorization Act (NDAA), which is awaiting consideration by the full House of Representatives.

“Defense contractors are ripping off the American people and our troops, and I'm doing something about it,” said Congressman Deluzio. "For way too long, loopholes, intense consolidation, and lax rules let giant defense corporations line their pockets with public money without many requirements to show that they’re giving the Defense Department a fair deal. We need to rework our systems to be more transparent and better protect the money all of us pay toward our defense. Enough with overpaying defense contractors. The Best Price for Our Military Act of 2025 will strengthen oversight and protect our military from getting ripped off.”

The Best Price for Our Military Act is a common sense measure to hold industry accountable,” said Congressman Moylan. “This bill is based on simple business principles, and empowers the Department of Defense to enter into contracts with sufficient pricing information. Congress has long been aware of ballooning prices for our military, but Rep. Deluzio and I are actually taking action by building a bipartisan coalition to tackle this issue.” 

This updated legislation builds on Deluzio and Moylan’s original bill introduced in 2024, which aimed to close a key loophole in the Truth in Negotiations Act by requiring defense contractors to submit certified cost and pricing data before final contract negotiations. The 2025 version includes a timing adjustment to ensure that pricing data submitted is not over 30 days old. 

Some of the key provisions of the Best Price of Our Military Act of 2025 include: tightening the Truth in Negotiations Act, closing the loophole that allows contractors to submit data after contract price is agreed upon, and reinforcing the requirement that transparent cost information be provided quickly to give the Department of Defense negotiation leverage.  

This legislation is part of Congressman Deluzio’s ongoing efforts to fight price gouging and grow real competition across the defense industrial base. He is one of the leading voices in the House of Representatives fighting for stronger competition and against price gouging in the Department of Defense (DOD). Congressman Deluzio secured several pieces of language in the Fiscal Year 2026 committee-passed NDAA to tackle these issues head-on, and it’s been a top priority in his NDAA work every year he has been in Congress. He previously introduced the Stop Price Gouging the Military Act with Rep. John Garamendi (D-CA-08), Senator Elizabeth Warren (D-MA), and Senator Mike Braun (R-IN) to close loopholes in current acquisition laws, tie financial incentives for contractors to performance, and provide the DOD with the information necessary to prevent future rip offs.
